1. Introducationec-sell.com is an eCommerce platform that allows users to sell and buy merchandise online in the United States. The actual buy and sell contracts are between buyers and sellers and we are not a party to any of the transactions.This User Agreement posted on our website explains the term on which offers you to access to our site and use of our services. You need to agree to and comply with all terms on this User Agreement when accessing or using our services. The entity which you are contracting with is EC INC, 12838 Lorne St., N. Hollywood, Ca. 91605. In this User Agreement, this entity is individually and collectively referred to EC INC, ec-sell.com, we, our or us. We may update this User Agreement from time to time without prior notice to you. We encourage you to review our User Agreement periodically for any updates.
2. Using our servicesWhen using our services you agree to comply with this User Agreement and you will not do as the follows:
To breach any laws, regulations (federal, state and local), third-party rights or our policies.To use our system if you are not able to legally bind contract with us (e.g. You are under
18 years old)To use our service if you are a suspended user during the suspending period.For a seller to post any false, inaccurate, deceptive or misleading listing.For a seller to create listings and upload content in inappropriate categories on our site. For a seller to infringe the trademark, patent, copyright or other intellectual property rights
that belongs to someone else.For a seller to charge buyer without having the order delivered.For a buyer to make a Negative Feedback without communicating with seller first.For a buyer to intentionally abuse our feedback system to adversely affect a seller's rating.For a buyer to refuse payment for an order has been delivered and approved.If we believe that you are in violation of the above stated regulations, we'll send you a warning notice at the first time and in our sole discretion to suspend or terminate your user account for ensuing violations. 3. Listing RequirementsWhen creating an listing for sale at ec-sell.com, you agree to comply with our policies listed below: ec-sell.com does not allow items that promote hatred, violence or discrimination of any kind or form.Describe as accurate as possible about the item you are selling. You'll assume a full responsibility for the item you offered.When you create a listing you'd agree to share your item's information and images to other users if they sell the exact item as you have listed. However it is encouraged for users to create their own descriptions and images.
Do not copy item description or images from other websites to avoid any copyright infringement claims.Duplicate listings with identical items are not allowed. However identical items with different variations are allowed.Using Metagags or URL links to redirect to a different website is not allowed.You will not sell any product recalled by a manufacturer or a product has health or safety hazard as specified by any governmental agency. We have no responsibility or liability for users to sell aforementioned products. You as the seller is solely responsible for that.You will not sell any Intellectual Property products including but not limited to Copyright, Patents and Trademarks. 4. Selling on ec-sell.comEach registered email address may create up to 3 selling accounts.The fees EC INC. charges for each sale is fixed at 15% at this time (including credit card transaction fees).Each account can list up to 200 items but double listing is prohibited.Our shopping system adopts very stringent Authorize and Capture technic to only accept credit card if the order is shipped to the billing address of the credit card which stops most of the fraud.
Seller to refund customer completely or pay return shipping if wrong or damaged item/items are shipped.Seller is responsible to collect sales tax and report to state at the rate according to the business reside state respectively.We are going to setup an automated bank payment method with seller and payments will be sent on each 1st. and 15th. of a month.
5. Buying at ec-sell.com
Buyer is responsible for reading the full item description before placing any order.Buyer is responsible to contact seller if there is any questions about an item before place the order.You enter into a binding contract with the seller when buying an item from them.Cancel an order usually will be accepted by seller if the order has not been shipped. However there are cases that seller won't accept Cancel Order with suitable disclosure in item description. e.g. made to order business.When the issue arises with an order, buyer is responsible to contact seller and discuss a way to resolve the issue before report a Negative Feedback rating which will help seller to improve his or her business.If return an order is inevitable, buyer is responsible for return shipping, if it was not the fault of seller. Tracking number is required for any return orders.
6. Content of Item
When adding or editing the content of an item you agree to follow our Listing Requirements as a guideline. When you provide the content for an item at ec-sell.com, you represent and warrant that, for all such content you've provided is accurate. You also represent and warrant that use of it by us and our users which in compliance with our user agreement does not and will not infringe any Intellectual Property Rights of any third party. ec_sell.com takes no responsibility and liability for any content provided by you. When you provide the content for an item at ec-sell.com, You grand EC INC. a non-exclusive, perpetual, irrevocable, royalty-free right to exercise any or all Intellectual Property Rights you have claimed that you have in the content in connection with our services. To the fullest extent permitted under applicable law, you promise to waive your right to enforce your Intellectual Property Rights in the content against us in connection with the service of ec-sell.com. 7. Indemnity
You will indemnify and hold EC INC. harmless from any claim or demand, including legal fees made by any third party due to your improper use of services, your breach of any law or the right of a third party.
